A homeowner may receive a warning, tax arrears certificate, final notice or information about a potential municipal tax sale. At that point, waiting can reduce the time available to arrange financing and protect the property.

If a property tax sale deadline is approaching in Ontario, the equity in your home may provide another option before the situation advances.

Why Property-Tax Arrears Become a Mortgage Emergency

Property taxes are secured against the property. Unpaid balances can grow through interest, penalties and collection expenses, and the municipality may eventually begin a formal process to recover what it is owed.

The homeowner may still be making the regular mortgage payment. The property may also be worth substantially more than the combined mortgage and tax debt. However, conventional lenders often become uncomfortable when serious property-tax arrears appear during underwriting.

This can prevent the homeowner from obtaining the exact refinancing needed to repay the municipality.

Financing the Tax Payout Through Home Equity

Where sufficient equity exists, Lendworth may review a property-tax arrears mortgage, private first mortgage, second mortgage or refinance.

The appropriate structure depends on the existing mortgage, the amount owing, the property value and whether the first mortgage should remain in place.

A second mortgage may make sense when the existing first mortgage has favourable terms and only a defined amount is needed. A full refinance may be considered when the homeowner also needs to replace a maturing mortgage or consolidate other obligations.

Mortgage proceeds can be directed through the closing lawyer to satisfy the confirmed municipal payout and any other approved debts.

Do Not Guess at the Amount or Deadline

The first step is obtaining written confirmation of the total amount required and the applicable deadline. The figure may be higher than the arrears shown on an older tax bill.

Homeowners should also obtain independent legal advice if formal tax-sale documents have been received. Mortgage financing is not a substitute for legal advice, and Lendworth does not determine or extend municipal deadlines.

However, acting early may provide more time to assess the property, order necessary searches, review the equity and coordinate the payout with the municipality and lawyers.

If your property-tax arrears are moving toward enforcement, call Lendworth at 905-597-1225 or request an urgent equity review.
