Siblings may own a home together. Friends may have purchased an investment property. A parent and adult child may share title, or two business partners may jointly own real estate.

When one owner wants their equity and liability removed, the remaining owner may need to refinance the property before a specific deadline.

Removing an Owner Is More Than Changing the Title

A registered owner cannot usually be removed from the mortgage simply because both parties agree.

The existing lender may require a new application to confirm that the remaining owner can carry the mortgage alone. If the departing owner is also receiving money for their share, the refinance must be large enough to repay the current mortgage and complete the buyout.

The bank may decline when the remaining owner’s income, credit or debt ratios do not fit its guidelines, even when the property contains strong equity.

How an Equity-Based Buyout May Work

Lendworth may review a mortgage refinance based on the property value, existing mortgage, agreed buyout amount and remaining owner’s plan.

A private first mortgage may replace the current loan and provide the funds required to pay the departing owner. In some circumstances, a second mortgage may cover the buyout while the existing first mortgage remains in place, provided the lender and legal arrangements permit it.

The transaction should be supported by a written agreement, valuation and independent legal advice. Each owner may need separate representation depending on the circumstances.

The Exit Strategy Matters

A private mortgage can create time, but it should not be treated as the final solution without a plan.

The remaining owner may intend to refinance with a bank after improving documented income, consolidating debt, completing renovations or establishing a stronger payment history. The property may also be sold later if carrying it alone is not sustainable.

Lendworth’s private mortgage options can be reviewed when a conventional lender will not approve the ownership change before the deadline.
