Then the bank refuses to advance the takeout mortgage because the final occupancy approval has not been issued.
Meanwhile, the construction mortgage is approaching maturity, interest continues to accumulate and outstanding contractors may still need to be paid.
Why a Missing Occupancy Approval Delays Refinancing
A conventional lender generally wants confirmation that the property can be lawfully occupied and used as intended. Missing inspections, incomplete permit items or outstanding deficiencies can prevent the municipality from issuing the required approval.
The bank may also need a completed appraisal based on the finished property. If the appraiser must value the home as incomplete, the approved mortgage amount may be reduced or the application may be suspended.
This leaves the borrower caught between two lending stages. The construction lender wants repayment, but the permanent lender will not fund yet.
Short-Term Financing May Create Time to Finish the Process
Lendworth may review construction-loan options based on the current property value, stage of completion, existing debt and work still required.
A short-term private mortgage may provide time to complete outstanding inspections, correct deficiencies, obtain final documentation and arrange conventional takeout financing. Funds may also be considered for approved construction expenses when there is enough equity and a credible completion plan.
The borrower should not treat private financing as permission to occupy a property without municipal approval. The objective is to stabilize the financing while the legal construction and inspection requirements are completed.
Build the Exit Strategy Before the Current Loan Matures
The application should include the building permit, inspection records, outstanding deficiency list, contractor estimates, existing construction-loan statement and an updated appraisal if available.
Lendworth will also review how the short-term mortgage will be repaid. The exit may involve a new first mortgage, a conventional refinance after final completion or the sale of the finished property.
If the current construction mortgage is close to maturity, do not wait for the lender to begin demanding repayment. Early review creates more time for valuation, legal work and a properly structured solution.
